Court to Reexamine Ruling That Allowed Former President to Send Troops to Portland

The ninth circuit court has upheld a ban on sending national guard in Portland, Oregon, following a recent court ruling.

Judicial Panel Concurs to Rehear Legal Matter

The federal appeals court decided on Tuesday that it would rehear the case concerning the president’s authority with an expanded group of 11 judges. The judicial body also overturned a previous decision from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Military Presence

This order represents the latest turn in a protracted legal battle over whether the administration has the authority and valid reason to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in due to ongoing demonstrations.

Conflicting Arguments

The administration has argued that federal officials at the immigration center in south Portland were under attack, while local authorities maintain that municipal police have command of the circumstances.

In defiance of characterizations of Portland as a conflict zone, locals have been posting videos of scenic paths and a thriving food scene, and organizing activities such as an Emergency Naked Bike Ride against the increased military presence.

Court Proceedings

The appeals court decision came after a federal judge in Portland issued two legal injunctions this month – one preventing the federalization of the Oregon national guard, and another prohibiting the use of any national guard troops in the state, after attempts to circumvent the first order by mobilizing out-of-state forces.

On the previous day, the appeals court had put the first ruling on hold – permitting command of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the forces.

The latest ruling means the issue will be heard by the full court – with all decisions under review simultaneously – by a group of 11 judges.

“This ruling shows that facts are important and that the judicial system are striving to ensure government responsibility. The founding document restricts the president’s power, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a statement.

“The court is sending a definite signal: the executive leader cannot dispatch the armed forces into American urban areas unnecessarily. We will continue protecting state legislation, principles, and sovereignty as this case moves forward and our fight continues in the courts.”
